Appeal from Thirteenth Judicial District Court,' Parish of Rapides; Jas. Andrews. Judge. Suit by James M. Kinberger against Mrs. E. M. Drouet and others. Prom a judgment in favor of defendants, plaintiff appeals.

1Opinion of the CourtLand, J.

On January 20, 1913, Mrs. Eleanor M. Drouet, wife of P. C. Drouet, leased to plaintiff; certain lands described in said contract of lease for a period of five years commencing from January 1, 1913, and ending December 31, 1917, at an annual rental of $300 for the first year and. $350 for each succeeding year until the termination of the lease.

It was agreed between the parties that the plaintiff should have the right, at.any time during the pendency of said lease, .to purchase the lands leased,' and several small tracts not included in the lease, for the sum of $50 per acre, to be paid in cash…
