Cerbone, J., at hearing, trial and sentence), rendered May 12, 1988, which convicted defendant of assault in the first degree and sentenced him to an indeterminate sentence of 10 years to life imprisonment, unani*268mously reversed, on the law, and the matter remanded for a new trial.
