OPINION

McHUGH, Associate Presiding Judge:

{1 The State appeals from the magistrate's pretrial order dismissing with prejudice the refiled information charging defendant Joel F. Pacheco-Ortega with attempted murder with injury and aggravated kidnap ping. 1 We reverse.

BACKGROUND

T2 On October 7, 2008, the State filed an information charging Pacheco-Ortega and his co-defendant, Luis Ceron (collectively, co-defendants), 2 with one count of attempted murder with injury, see Utah Code Ann. § 76-5-203(2) (2008), and one count of aggravated kidnapping, see id. § 76-5-302.
