MEMORANDUM

VANASKIE, Chief Judge.

On April 1,1999, plaintiff S.M., on behalf of her minor child, L .G., commenced this civil rights action pursuant to 42 U.S.C. § 1983, alleging constitutional violations arising from an incident during which L.G’s fifth grade teacher, Anthony Cerra, repeatedly yelled at her during math class. 1 Named as defendants are Cerra, the Lakeland School District, and Robert Gigharelli, the School’s Superintendent. 2 Cerra is sued on the basis of his alleged verbal abuse of L.G.
