OPINION

BUSSEY, Judge:

The appellant, John Franklin Wills, hereinafter referred to as the defendant, was convicted in Tulsa County District Court, Case No. CRF — 78-3382, of Manslaughter in the Second Degree, After Former Conviction of a Felony, was sentenced to nine (9) years’ imprisonment, and he appeals.

On December 23, 1978, while residing at the Tulsa YMCA, the defendant and James Rogers became involved in a heated exchange of words. Rogers had made homosexual advances toward another resident of the YMCA, Bruce Flick, who was in a leg cast at the time and could not physically defend himself…
