Plaintiff brought this action to recover damages allegedly caused by the negligence of defendant railroad company. The accident occurred on April 20, 1956, in the village of Gregory, Livingston county, Michigan, on State trunkline M-36 where it intersects the defendant’s railroad. Around noon of that day plaintiff was proceeding in a southerly direction on highway M-36 and defendant’s freight train was proceeding in a westerly direction toward the highway.
