The plaintiff brought this action against Bernard J. Somers and Trofimena Battipaglia, claiming a declaratory judgment and injunctive relief. The complaint alleged that the plaintiff had issued a policy of automobile liability insurance to Anne Somers; that during the period of coverage of the policy a car owned by her and operated by Bernard J.
