MEMORANDUM OPINION AND ORDER
ALBRITTON, Chief Judge.
I. INTRODUCTION
This cause is before the court on a Motion for Summary Judgment filed by Defendant Robert Head on August 30, 2002 (Doc. # 25).
The Plaintiff, Norma Sue Brown, filed a Complaint on November 21, 2001, bringing claims under 42 U.S.C. § 1983 and under state law against Elmore County, Alabama, and Robert Head. The two Defendants responded by filing separate Motions to Dismiss. (Docs #7 & 9).
