MEMORANDUM OPINION AND ORDER

This matter is before the Court on the Motion for Summary Judgment (Doc. # 15) filed by Defendants L.P. Walker (“Walker”), O.V. Chavez1 (“Chavez”), and Kevin Murphy (“Murphy”) (collectively, “Defendants”) on January 28, 2013. The Court has reviewed the submissions of the parties and finds that, for the reasons set forth below, the Defendants’ motion is due to be GRANTED IN PART and DENIED IN PART.
