Presently before the Court is the Motion to Permit Filing, Allowance, and Payment of Claim for Post-Confirmation Attorneys Fees (the “Motion”) filed by CoBank, ACB (“CoBank”). The Motion has drawn an objection from the FCA PosUConfirmation Trust (the “Trust”). The dispute provides a fascinating look at the pitfalls of a partial settlement. The parties’ remaining differences have apparently resulted in hundreds of thousands of dollars in fees and expenses. CoBank asks the Court to shift most, if not all, of its expenses to the Trust.…
