John W. McDonald, the relator, applied to the district court for Dawes county for a writ of mandamus commanding the respondents, the county commissioners and the county clerk of said county, .to include in their estimate and levy of taxes an amount sufficient to pay relator’s claims against the county, together with interest thereon, but not to exceed the aggregate amount limited by law for such estimate and levy.
