This is an appeal from a judgment of conviction of murder rendered after a jury trial, under the law prior to its revision of September 1, 1974, upon an indictment charging "murder, in violation of section 125.25, subdivision 1 of the Penal Law of the State of New York, committed as follows: The defendant on or about June 4, 1974 in the County of Monroe knowingly and intentionally caused the death of another person, to wit, Ellis Miller.” In its instructions to the jury the court charged that to establish defendant’s guilt of murder the People had the burden of proving beyond a reasonable…
