This is an appeal from a judgment of non-suit rendered in an action brought by the appellant to recover damages for personal injuries sustained by appellant while engaged in “staking” cars at Hart’s mill, on the line of the Tacoma Eastern Railroad.

The facts, briefly stated, are as follows: The respondent George E. Hart was the owner and operator of a sawmill near the city of Tacoma on the line of a railroad belonging to the Tacoma Eastern Railroad Company, a corporation, and one of the respondents herein.
