SELBY, Justice.

The State of Indiana is appealing the dismissal of its reckless homicide ease against defendant Stephen Hurst (“defendant”). Defendant moved to dismiss in the trial court on the grounds that the reckless homicide charge would violate his double jeopardy rights because he had previously been tried for a traffic violation arising from the same facts. The trial court granted the motion. On appeal by the State, the Court of Appeals affirmed the trial court’s decision. State v. Hurst, 674 N.E.2d 622 (Ind.Ct.App.1996).
