This is a suit for the price of furniture sold and delivered.

The plaintiff alleges that he sold and delivered to the defendant a lot of furniture; that in part payment thereof the defendant subscribed a note for $600.00 dated May 13, 1921, payable ninety days after date with eight per cent interest from date until paid; that the defendant has paid $200.00 on account of said note, leaving a balance due of $400.00; plaintiff further averred that it had a vendor’s privilege on said furniture and that it feared that the said Louis J.
