PUTNAM, Circuit Judge.

This suit was brought by the plaintiff in error for an injury occurring to him while riding in a passenger train of the defendant in error. The circuit court directed a verdict for the defendant, and the plaintiff below thereupon sued out this writ of error. The record raises two questions: First, whether there was any case to go to the jury on the allegation of negligence; and, *851second, whether or not the plaintiff was a passeaiger.
