PUTNAM, Circuit Judge.
In Powers v. Hospital, 47 C. C. A. 122, 109 Fed. 294, this court held that that action, based on the alleged negligence of a nurse employed by the hospital, could not be maintained in behalf of one of its patients. The case now before us the defendant claims is within the principle of our former decision. The plaintiff undertakes to distinguish the two on the alleged ground that in Powers v. Hospital there was no negligence on the part of the defendant in employing the nurse, while in the case at bar there was negligence in employing the person through whose want of…
