From Umatilla: William R. Ellis, Judge. Action by G-. D. Simmons against tbe Oregon Railroad & Navigation Co., to recover damages for injuries received in a collision on defendant’s road. There was a verdict and judgment for plaintiff for $20,700, from which defendant appeals.

This is an action to recover damages for personal injuries suffered by the plaintiff through the negligence of the operators of a train upon which he was riding. For some eighteen months prior to the accident he had been employed by the defendant company as a fireman on one of its helper engines at Kamela, a station on the summit of the Blue Mountains. He was paid by the “run,” receiving no compensation when not at work.
