Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Commissioner of Motor Vehicles which suspended petitioner’s repair shop registration for five days and imposed a civil penalty of $200.

Petitioner is the operator of a licensed motor vehicle repair shop specializing in automobile transmission work. As the result of a complaint filed by one of its customers, Robert Turner, the State Department of Motor Vehicles issued a notice of hearing to petitioner alleging the following…
