Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Comptroller, which denied petitioner’s application for accidental disability retirement. Petitioner was a Nassau County police officer who, by application dated March 23, 1977, applied for accidental disability retirement (Retirement and Social Security Law, § 363) because of problems with his right ankle.
