Plaintiff appeals from a judgment dismissing its complaint for failure to allege ultimate facts sufficient to constitute claims for negligent misrepresentation, contribution, and indemnity against defendant. ORCP 21 A(8). We affirm.
We state the facts as alleged in the complaint. McAlpine v. Multnomah County, 131 Or App 136, 883 P2d 869, rev den 320 Or 507 (1995). Plaintiff insured McLeod, the owner of the Rockwood Apartments, under a commercial comprehensive liability insurance policy.
