This is an action in two counts; one, to contest the will of Josiah M. Hammonds and, two, to set aside two deeds to certain lots in the town of Malden in Dunklin County. Originally the appeal was to the Springfield Court of Appeals but the action and judgment involve the title to real estate and for that reason the appeal was appropriately transferred to this court. Hammonds v. Hammonds, Mo. App., 289 S.W.2d 903.
