MEMORANDUM OF OPINION

THORNBURG, District Judge.

THIS MATTER is before the Court on numerous motions and cross motions for summary judgment.

I. PROCEDURAL HISTORY

On March 26, 2002, Plaintiff Ramsey Group, Inc. (Ramsey) initiated this action seeking declaratory judgments that it has not infringed United States Patent No. 6,308,728 Bl (’728) for a spill containment system and method and that the patent is invalid.
