Before the Court in the above-captioned case 1 are the parties’ cross-motions for summary judgment. Upon careful consideration of the parties’ pleadings, the entire record herein, and the law applicable thereto, the Court shall grant the defendants’ Motions for Summary Judgment on the plaintiffs claims under the CERCLA for past costs he has incurred investigating contamination located at his property in Southwest Washington, D.C., and on the defendants’ counter-claims against the plaintiff that he is liable under the CERCLA as a current owner of the property.…
