Appeal from circuit court, Hew York county. Action by Ruth Torbett, as assignee of Hattie Patterson Brooks and others, against Parke Godwin. On trial before a jury, they found a verdict for plaintiff. A motion by defendant for a new trial was denied, and judgment for plaintiff was entered on the verdict. Defendant appeals from the judgment and the order denying his motion for a new trial.

The plaintiff brings this action as the assignee of five employes of a corporation known as the American Opera Company, Limited, to recover from the defendant the claims of these employes against such corporation. It is sought to charge the defendant as a director of the company under section 21 of chapter 611 of the Laws of 1875, pursuant to which act the corporation was organized.
