Judgment of the Supreme Court, New York County (Martin Rettinger, J.), rendered on April 25, 1989, which convicted defendant, following a jury trial, of criminal sale of a controlled substance in the third degree and sentenced him, as a predicate felon, to a term of imprisonment of from AV2 to 9 years, is unanimously affirmed.
