Dennis Hess purchased property in Platte County, Missouri, from Chase Manhattan Bank (“Chase”) for $52,000 in April 1999. At the time of the sale, Chase was *763aware that the property was being investigated by the United States Environmental Protection Agency (“EPA”) in connection with illegal hazardous waste dumping on the property by its prior owner, on whose mortgage Chase had foreclosed.
