Lewis Heberer sued defendants alleging they made false collateral misrepresentations to him by falsely representing he would be given the right to operate a new service station to be located at 1240 Brent-wood Boulevard if he would extend his current 3-year lease as a Shell dealer at 1421 Brentwood Boulevard.
