MURNAGHAN, Circuit Judge:

In June of 1991, the Church of Scientology International (CSI) ran a series of full page advertisements in USA Today Newspaper. Several of the ads spoke out against the use of drugs for the treatment of mental illness and depression, and targeted in particular the drug Prozac and its manufacturer Eli Lilly & Company. “Eli Lilly: Purveyor of dangerous drugs,” read one caption. “What U.S. Drug Company Produced a Drug Named After Adolf Hitler?” asked another. “How much more human misery will occur before Eli Lilly & Company is held accountable for the effects of…
