1. One of the assignments of error complains of the ruling of the trial judge in refusing to direct a verdict in favor of the defendant upon proper motion at the conclusion of the evidence. While a trial judge may, -within the restrictions pre.scribed by the Civil Code, §5331, direct a verdict in a proper case, this court will in no case overrule as erroneous a refusal to do so.
