An action was instituted by the defendant in error against the railroad company, to recover damages for the homicide-of her husband, which she alleged was occasioned by the operation of a train of cars over defendant’s railroad, at a public crossing.. The evidence relied on by the plaintiff in the court below .as a, basis of recovery was substantially as follows; Robinson, the husband of the plaintiff, was a watchman at a sawmill located at a point-near the railroad.
