Plaintiff appeals from an adverse judgment in an action in which he sought to cancel two deeds.

Defendant, who wanted to lease some property in Shasta County, was introduced to plaintiff, who offered to sell a 5-acre tract for $750. After some discussion, defendant agreed to lease a portion of the property and a lease for a period of 10 years was entered into in April 1957. The total rental was $250, of which $100 was to be paid in May 1957 and the balance was to be paid in September 1957, if the water supply was adequate.
