This is an action to recover the possession of 287 acres of (410) land. Plaintiffs claim the land as the widow and heirs at law of Travis Seals. Defendant is the brother of Travis Seals, who has since died. The defendant thus states his contentions in his brief:

"There are two causes of action alleged in the complaint, the first being in the nature of an action of ejectment, and the second for the surrender and cancellation of a deed made by the plaintiff Elizabeth Seals to Alexander Seals on 21 April, 1893, which deed conveyed, or purported to convey, the land described in the complaint.
