This is an original action in this court in mandamus. The superintendent of the department of public works of the state of Ohio advertised for bids for the construction of a power house, and equipment, as an addition to the Longview State Hospital at Cincinnati; said bids to be opened on September 23, 1930. Four bids were submitted, the relator, the Elliott Company, being the lowest bidder, in the sum of $35,215. The petition alleges, and the general demurrer to the petition admits, that the superintendent of public works was authorized to construct the power house, and to receive bids…
