MEMORANDUM OPINION

PROPST, District Judge.

This cause comes to be heard on plaintiff’s April 13, 1984 motion, which seeks summary judgment with respect to the second, third, fourth, fifth, sixth and special defenses raised by defendants in their answer. Plaintiff, “Federal Deposit Insurance Corporation, in its corporate capacity,” brings this action against the directors of the Cedar Bluff Bank for breach of fiduciary duty and negligence.
