J.—The appellant instituted this action before a justice of the peace, to recover from the appellee for. the use and occupation of a tract of land described in the complaint.
The appellee appeared and filed an answer, in which he alleged, in substance, that in the year 1865, he and the appellant entered into a parol contract, whereby the appellant agreed, in consideration of the fact that the appellee had married the daughter of appellant and the agreement to pay the appellant in the month of December, 1867, the sum of five hundred dollars, to sell and convey the said premises to the…
