Movant was convicted of capital murder pursuant to § 565.001 1 and was sentenced to life imprisonment without eligibility for parole for fifty years. This Court affirmed Movant’s conviction and the denial of post-conviction relief in State v. Kennedy, 726 S.W.2d 884, 888 (Mo.App. S.D.1987) and Kennedy v. State, 771 S.W.2d 852, 859 (Mo.App. S.D.1989), respectively.
