In its motion for a rehearing the plaintiff in error contends that this court in ruling as it did in Division 4 of its opinion overlooked the fact that the trial judge in his opinion written in this case did not hold that the representative of the plaintiff in error with whom the process was left was an agent of the corporation upon whom service could be had and further that the ruling by this court that he was such an agent is contrary to the opinion and judgment of this court in the related case of Clements v.
