By the Court The plaintiffs in their complaint, after averring their partnership, alleged that at divers times between the 16th of September, 1868, and the 18th of October, 1863, at Jamestown, N. Y., they sold and delivered to the defendant, divers goods, wares and merchandise at divers prices, such prices amounting in all to one thousand and sixty dollars, which sum defendant in consideration thereof, agreed to pay plaintiffs, and allege certain payments thereon by the defendant.
