This matter is before the court on the plaintiff Commerce Union Bank’s complaint seeking relief from the automatic stay imposed pursuant to 11 U.S.C. § 362 so that Commerce Union may exercise its right of setoff against the debtor George N. Welch’s demand deposit account in the amount of $8,114.37. In response, the trustee in this case has filed a counterclaim against Commerce Union essentially alleging that Commerce Union converted property of the debtor by depositing a $63,000.00 third party check made payable to the debtor in the debtor’s…
