Read, as assignee for .the benefit of creditors of Cary D. Lindsay, by the filing of a petition in said court, asking for an order to sell certain of the assigned real estate to pay debts. On the trial of this cause in the court of' common pleas, at the request of the plaintiff, the court made and stated it's finding of facts separate from its conclusions of l'aw, and the facts so found and stated by said court of common pleas are admitted to be correct, and they are not here in dispute. The sole controversy in this case arises upon the statement of facts contained in paragraphs four and five of its findings of fact so made by said court of common pleas.
