I. The amended and substituted petition alleged that the plaintiff and defendant entered into a written contract whereby the plaintiff undertook to manufacture and deliver to the defendant certain artificial architectural stone, to be used by defendant in the construction of a school building at Council Bluffs. It alleged that the greater part of the stone was delivered, and that the defendant refused to accept further stone, and elected to rescind the contract. The contract is set out.
