On August 6, 1921, defendant in error, plaintiff below, began her action in the district court of Oklahoma county against the plaintiff in error, defendant below, for damages resulting to the next of kin, for the wrongful death of E. L. Castile, the husband of the adminis-tratrix, resulting from injuries received while the said E. L. Castile was an employee of the plaintiff in error.
