THIS MATTER comes before the Court on: (i) the United States’ Sentencing Memorandum and Recommendation, filed October 10, 2012 (Doc. 58)(“United States’ Memo.”); and (ii) the Defendant’s Sentencing Memorandum and Motion for Sentence Varying from the Guideline Range, filed.
