OPINION AND ORDER

¶1 On March 26, 2009, the Office of the Attorney General for the State of Montana (the State) filed with this Court a Petition for Writ of Supervisory Control over the District Court for the Thirteenth Judicial District, Yellowstone County, in Cause No. DC 2008-360. In that case, the Honorable Susan P. Watters issued an order on February 2, 2009, wherein she ruled that § 61-7-103, MCA, was unconstitutionally vague on its face and as applied.
