INTRODUCTION

Plaintiff, Roberto Rodriguez (“Rodriguez”), brought this action alleging numerous violations of 42 U.S.C. § 1983. At all times relevant to this action, plaintiff was an inmate in the custody of the New York State Department of Correctional Services (“DOCS”).
