This is an equity action brought to declare a deed a mortgage, and to decree certain taxes paid by the grantee a lien on the land. The facts are as follows:

On December 27, 1919, Emil Tangen was the owner of the west half of the southwest quarter of section three, and. the northwest quarter of section ten, township one hundred fifty-one, north .of range seventy, west, Benson county, North Dakota. On that day Tangen and his,wife mortgaged the said premises by giving three mortgages thereon: — one for $5,000 to the Citizens State Bank of Maddock; one for $500 to the Citizens…
