The complaint in this action alleges that prior to December 5, 1885, one Thomas O’Toole, since deceased, was the owner of the N. J4 of the N. E. 34 of section 21 and the WJ4 of the N. W. 34 °f section 22, in township 159 N., of range 55 W., in Pembina county, N.
