The plaintiff in error, hereinafter called the defendant, was charged by information with willfully, unlawfully, and feloniously abandoning and deserting his wife, Winnie Hammons; was tried and convicted and sentenced to imprisonment in the state penitentiary for a term of seven years; motion for new trial was filed, considered, and overruled; and the defendant has appealed to this court. On the 5th day of September, 1927, the defendant appeared in open court and waived arraignment and took time to plead.
