A more extraordinary case than this rarely finds its way into court. Some of the salient features of it, which the jury could find from the evidence, were as follows: T. A. Ausley, a real-estate agent, pretended to W. E. Smith and his associates that a certain plantation in Florida could be bought for an amount somewhat in excess of $40,000, that it was partly planted in pecan trees, and that by setting out other trees it could be sold to E. E. Vinson for $185,000, payable in installments. As a means of inducing them to make the trade, he led them to believe that Vinson had deposited $4,000…
